Booking Terms & Conditions
1. YOUR BOOKING
a) This booking is made between Elysian Collection GmbH (“EC”) and the signatory of the Chalet Rental Agreement (“CRA”), who must be over 18 years of age at the date of signature (“the Client”). All correspondence to be addressed to Elysian Collection GmbH, Haus Elias, Bahnhofstrasse 15, Zermatt, CH-
3920, Switzerland or emailed to info@elysiancollection.com.
b) These Booking Terms & Conditions (“T&Cs”) constitute part of the CRA between EC and the Client and are applicable in all circumstances, including before and after the Client’s stay at the property. The T&Cs are also applicable to any and all attendees at the property, including guests, visitors, staff, group leaders, friends and service providers (“the Attendees”).

2. PAYMENT & CONFIRMATION CONDITIONS
a) To confirm the Client’s booking, the fully completed and signed CRA, including full credit card details, must be returned to EC within 3 working days of receipt by the Client, and a deposit of 25% made within 5 working days of the date the CRA is emailed to the Client.
b) In the event that EC does not receive the fully completed & signed CRA and deposit payment within the previously stated time frame the Client’s booking offer from EC will expire, which may lead to the lapse of the Client’s provisional booking if another party seeks to book the property during the Booked Period previously covered by the Client’s provisional booking. We reserve the right to cancel a provisional booking until such time as the above conditions are met.
c) The balancing 75% of the booking fee must be received 70 days prior to arrival.
d) All bank charges and any other incidental amounts in excess of the amounts noted in the CRA are to be paid by the Client.
e) For bookings made within 70 days of the arrival date, the amount must be paid in full, within 5 working days of receipt of the CRA by the Client.
f) The requested credit card details must be noted on the signed CRA in full. Provision of these details constitutes agreement to authorise EC to charge the credit card holder for any damages incurred to the Property during the Booked Period by any of the Attendees that exceed the amount provided by the Client for the security deposit as noted in Section 3 below. The credit card holder may also be charged for any unpaid bills incurred by the Attendees at the Property connected with the Booked Period.
g) All credit & debit card payments will be processed in local currency (Swiss Francs - CHF) and will incur an administration fee of 2.5%.

3. SECURITY & BILLING DEPOSIT
a) All bookings with EC require a security deposit to be paid to cover any damage caused to the Property by the Attendees during the Booked Period, or any bills incurred by the Attendees still unpaid at the end of the Booked Period.
b) The security deposit is payable by bank transfer prior to the Booked Period; this can either be paid  together with the remainder rental payment, or as a separate payment no later than 14 days prior to the first day of the booking. The security deposit amounts are: 20’000CHF for peak weeks, 10’000CHF for non-peak weeks and 5’000CHF for summer bookings. The amount transferred will be held until after check-out and returned to the Client by bank transfer within one week of the Client’s departure from the Property, providing all bills associated with the Booked Period have been settled and no damages or losses to the Property are incurred.
c) The Client will liable for any breakages or damage to the Property or other property of EC during the Booked Period incurred by any Attendees to the Property. In the event of damage occurring, the Client will be provided with a description of the damage & associated cost prior to the amount being deducted from the security deposit; if the cost of the damage exceeds the amount of the security deposit EC are authorised as noted in section 2 (f) above to charge the amount outstanding to cover the damage occurred to the credit card holder.
d) EC reserve the right to use the Security Deposit for payment of any unpaid guest bills incurred.
e) EC recommend that the Client holds adequate insurance to cover accidental damage to the Property and its contents.

4. SPECIAL REQUESTS
a) Please inform EC of any special requests at the time of booking. EC will endeavour to fulfil any special requests made; however, EC cannot guarantee the execution of all requests and we shall not be held liable for failure to execute any such requests.

5. CANCELLATION & AMENDMENTS BY YOU
a) If the Client wishes to cancel a booking this must be done in writing, via email or via post to the registered address shown above; recorded delivery of any such postal notification of cancellation is strongly  recommended. Any cancellation will come into effect on the day the written or email notice (the “Cancellation Notice”) is received by Elysian Collection. Following any cancellation, the Client will remain liable to EC for the Cancellation Amount (as defined below by reference to the date on which the Cancellation Notice was  received by EC). In the event that EC have received the full balance payment for the Client’s stay the Client will be refunded the appropriate percentage detailed below:

b) Please be aware that any third-party services that may have been booked by EC upon your request (such as ski-guides, transfers and any other ancillary services) are subject to the terms & conditions and cancellation terms of the third-party service supplier.
c) The Client hereby agrees to indemnify EC of any cost or expenses incurred by it in relation to the cancellation of such services on their behalf, whether such services are cancelled in conjunction with the Booked Period with EC or separately of such.
d) EC cannot be held responsible for snow conditions, weather, decrees made by the federal Swiss or local government in relation to travel, the openness of ski facilities, or personal accident or illness suffered by Attendees, and as such, any cancellations made for these reasons will subject to the above conditions.
e) Any desired amendments to the Client’s booking must be confirmed in writing by the Client; such amendments will come into effect on the day they are received by EC. EC will endeavour to meet your request; however, this cannot be guaranteed; the Client agrees to indemnify EC for any reasonable expenses
incurred in making an amendment whether or not EC succeeds in confirming the request.
f) EC accepts no responsibility for late arrivals/early departures/under-occupancy for any reason and does not issue full or partial refunds in any circumstances, apart from cancellation of the Client’s booking by EC as noted in Section 6.

6. CANCELLATION & AMENDMENTS BY ELYSIAN COLLECTION
a) In all cases, EC reserve the right to cancel the Client’s holiday for the Booked Period. This is extremely unlikely, but should this event occur you will be fully refunded the amount paid.
b) EC reserve the right to advise the Client of a change to the booking before and after the Client confirms the reservation. An amendment made prior to the Booked Period which is deemed to be significant by EC (for example a change of dates or a change in accommodation standards to a lower standard) gives the Client the right to cancel the booking if the Client chooses. Should the Client cancel in such circumstances they will receive a full refund. EC will not be liable for any expenses, costs or losses incurred by the Client as a result of any change.
c) EC shall not accept liability and will not be liable for any refund should EC be forced to cancel or change the booking due to circumstances amounting to force majeure. Force Majeure in this instance should be taken to mean any event which EC could not, with all due care, foresee or avoid; such circumstances include, but are not limited to, war or threat of war, riot, civil strife, terrorism, industrial disruption, natural disasters, act of God, excessive snowfall or avalanche, fire, technical problems, adverse weather, the act of any government or other national or local authority, border closures, epidemic, pandemic and similar events beyond our control.
d) If the Client fails to pay the balance of the booking price or other costs before the due dates, or violates any other terms of this agreement, EC reserve the right to cancel the Client’s reservation; this will be treated as a cancellation by the Client and as such will be governed by the terms laid out in point 5(a).

7. PRICING & DESCRIPTIONS
a) EC endeavour to ensure that all information and prices displayed on our website and other marketing materials are accurate; however, in exceptional cases some errors may occur. EC reserve the right to correct errors in any quoted prices prior to confirmation of the Client’s booking and to amend inaccuracies in property descriptions and services offered at any time.

8. TRAVEL INSURANCE
a) It is a condition of the Client’s booking with EC that all members of the Client’s party are covered by comprehensive travel insurance which covers the Attendees adequately for accident, illness, repatriation, cancellation of the trip or curtailment, personal liability (to include, amongst other liabilities; damage
caused by you to the property in which you are staying) and any skiing or mountain activities such persons intend to partake in.
b) In the event that the Client or any members of the Client’s party fail to obtain suitable insurance EC shall not be liable for any costs incurred or claims made against EC due to their failure to comply with this term.

9. PASSPORT & VISA REQUIREMENTS
a) It is the Client’s responsibility to ensure that Attendees documents for travel are in proper order and that Attendees are deemed to be fit for travel. EC accepts no liability for any loss or inconvenience caused as a result of the Client’s failure to take reasonable care in this respect. Please be aware that the length of time it takes to obtain visas can vary, so EC recommends the Client to contact the appropriate Consulate at their earliest convenience.

10. YOUR RESPONSIBILITIES
a) As part of this contract the Client hereby agrees to guarantee payment for any chargeable services requested by the Client or any member of their group, whether such services are requested before, during or after the Booked Period.
b) The Client agrees to treat the Property and all EC property with care and respect; EC will be entitled to recover the cost of any damage caused or additional cleaning required as a result of the behaviour of any members of the Client’s group. Behaviour deemed unacceptable by us will result in the termination of the holiday and the Client shall have no right to a refund for the Booked Period or any expenses incurred as a result of the termination.
c) It is the Client’s responsibility to provide written details of any allergies or intolerances suffered by any member of the Client’s group; EC will not be liable in the event of any allergic reaction but will do their utmost to ensure that precautions are taken in respect of any allergies that we have been advised of and
acknowledged receipt of.

11. CONCIERGE & THIRD-PARTY ARRANGEMENTS
a) As part of the Client’s booking EC will organise all third-party arrangements in-resort and, if required, all transfers to and from Zermatt, unless the guest makes their own arrangements or requests otherwise. EC accepts full responsibility for these arrangements, but not for any costs incurred, which remain the liability of the Client throughout. These services are to include travel tickets, ski passes, ski guides/instructors, ski equipment, masseuse/beauticians, road transfers, helicopter transfers, nannies, musicians and entertainment.
b) Any booking made by EC on the Client’s behalf will be subject to the terms & conditions of the individual service supplier.
c) The costs of any reservations or services made on the Client’s behalf will be charged to the Client at the end of the Booked Period; all costs must be settled prior to the Client’s departure from the property.
d) Any third party handling a Client’s end of stay bill must be transparent regarding the pricing presented to them by EC.
e) Should the Client insist on a third-party Concierge, or undertaking their own concierge arrangements, we accept no responsibility for any disappointment caused.

12. END OF WEEK PAYMENTS
a) The Client’s end of week bill will be in the local currency (Swiss Francs - CHF). Any items/services recharged on the Client’s guest bill exclude VAT at 7.7%.
b) A visitor’s tax of 3CHF per adult and 1.50CHF per child is levied by the Zermatt Tourist Office on a daily per head rate. This will be charged at cost at the end of the Booked Period.
c) Cash payment in the resort is accepted in the local currency only.
d) Credit card payments will be processed in local currency and will incur a 2.5% administration charge. EC endeavours to supply services in-resort at cost, however some items may be subject to a 10% surcharge for services rendered (for example, personal shopping).
e) If the Client chooses to pay by Bank Transfer this should be received within 5 working days of departure from resort. In this case, the guest bill must be signed in resort with the Client’s Chalet Manager, and EC will hold the security deposit until payment is received. If the amount has not been received within 5 working days of the Attendees’ departure from the resort, EC will charge any amount due which exceeds the Security Deposit to the Credit Card, as well as the credit card administration fee.

13. USE OF THE PROPERTY
a) The Property is to be used only for the purpose of holiday accommodation; it is not permitted to use the Property for any commercial purposes (such as photoshoots or events) without prior written agreement from EC. Under no circumstances may the Client sublet the Property.

14. CHECK IN & CHECK OUT TIMES
a) All bookings are subject to a standard check-in time of 16:00, and check-out time of 11:00.
b) Should the Client wish an early check in or late check-out, EC will do their best to accommodate this, however this cannot be guaranteed. If granted, a fee of CHF200 per hour will be charged for any entries prior to 16:00, or departures after 11:00.

15. ANIMALS
a) No animals are permitted in any properties without prior agreement and written consent from EC.
b) In the event that EC grant permission for an animal to be accommodated in a property we reserve the right to request an increased security deposit and the following rules apply:
i. Animals are never to be left alone by Attendees in the chalet; they may only be left unattended in the ski room for short period.
ii. Staff are not responsible for walking/feeding or cleaning up after animals.
iii. Any damage caused by animals will be charged to the Client (e.g. damage to floors, scratches on doors etc).
iv. Animals not permitted on any furniture (beds/sofas etc).
v. An additional end of stay cleaning fee of CHF500 will be charged for all bookings where animals have been permitted.

16. SMOKING
a) Please note that smoking is not permitted in any of EC’s properties; smoking is permitted only on balconies and terraces.
b) In the event that smoking is found to have taken place in a property an additional cleaning fee of 500CHF may be charged.

17. VISITORS
a) The Client’s CRA will state the maximum permitted number of residential Attendees included within the Client’s Booked Period at the Property; only the number of persons stated may occupy and use the Property/facilities unless agreed otherwise in writing prior to arrival.
b) No additional persons may be permitted to stay overnight in the property or avail themselves of the facilities (for example, dining or use of the wellness) unless prior agreement from EC has been sought.
c) In the event that permission is granted for additional guests, EC reserves the right to charge an additional fee for this.

18. RULES & SAFETY PRECAUTIONS
a) The Client and the residential Attendees use of wellness facilities such as hot tubs, saunas and steam rooms are at the Client’s/Attendees own risk and EC can accept no responsibility for accidents/ injuries whilst using the facilities. Excessive use of hot tubs may cause skin irritation, which EC will not be responsible for.
b) The supervision of children is not the responsibility of EC and children may not be left without  Client/Attendee supervision in the Property, whilst in proximity to facilities including, but not limited to, hot tubs, saunas, steam rooms and fireplaces. Please note that the supervision of children is the Client’s
sole responsibility and children may not be left without Client supervision in the property.
c) No outdoor footwear is permitted to be worn in any properties; slippers are provided for this purpose.
d) If the Client or any member of their group engages in behaviour that is deemed to be dangerous, causes excessive disturbance, may result in damage to the Property or injury to a staff member or fellow guest EC reserves the right to terminate the booking without compensation.

19. SKIING & MOUNTAIN ACTIVITIES
a) It is the responsibility of the Client and their group to judge the suitability of each area in which the Client skis or undertakes mountain activities (for example, sledging or hiking) and to ensure it is well within the capability of the Client and their party members.
b) If the Client or any member of their group ski or undertake mountain activities in a location on the recommendation of, or are accompanied by any representative of EC, EC will not be liable for any injuries howsoever caused.

20. COMPLAINTS
a) If the Client is at all unhappy with any aspect of their holiday, they should address their complaint immediately to the Chalet Manager. In the unlikely event that the problem cannot be resolved locally, the Client must inform EC in writing of their complaint within 14 days of their return date so that the matter
may be investigated.

21. GENERAL
a) Headings within these booking conditions are for reference purposes only. All images/floor plans are intended to give a general impression only.
b) These booking conditions and any matters arising from them are subject to and governed by Swiss law and the exclusive jurisdiction of the Swiss Courts.

22. DATA PROTECTION
a) Please note that the personal information of all guests (name, address, age, telephone number, email and similar) shall be conserved in a confidential manner by EC for further reservations and to keep guests informed of special offers (if requested).

23. AMENDMENTS TO ABOVE
a) EC reserves the right to alter these terms and conditions from time to time and will notify the Client of any changes as soon as reasonably possible. The amended terms and conditions will apply to any booking that commences after the date of such notification.
